Refugee & Protection Claims in New Zealand
A refugee or protection claim concerns the risk a person would face if returned to their country. It is a specialised legal process, not an alternative way to obtain an ordinary work, study or visitor visa.
For a protection claim, deportation issue or appeal deadline, contact an appropriately qualified New Zealand lawyer or licensed immigration adviser. Do not rely on a website enquiry to preserve a deadline.
The New Zealand claim process
Immigration New Zealand's Refugee Status Unit administers the refugee and protection claim process. A claim must be genuine and assessed under the applicable New Zealand law and protection obligations.
The process includes confirming the claim in writing, providing a statement and supporting information, an interview, an opportunity to respond and a decision. A person's visa status and work permission need separate attention while a claim is considered.
Prepare an accurate account
Keep a careful record of events, dates and the original documents you already hold. Distinguish what you personally experienced from information someone else told you. Explain uncertainty rather than filling gaps with invented details.
Do not use another person's story as a template for your own claim. A representative needs the actual circumstances, including difficult or inconsistent information, to advise appropriately. Arrange suitable translation or interpretation where necessary.
Appeals and time limits
The Immigration and Protection Tribunal hears specified appeals involving residence, refugee and protection decisions and deportation liability. Not every immigration decision has the same appeal route.
The applicable form, fee where required and deadline depend on the matter. Read the decision and obtain advice immediately. A request for more information, a general enquiry or an intended future appointment is not the same as lodging a valid appeal.
Use official and confidential channels
Keep the original decision letter and contact details of any existing representative. Confirm that communications genuinely come from the relevant agency. Be cautious about anyone promising a guaranteed outcome or suggesting that inaccurate information should be included.
Do not submit a detailed persecution history, identity documents or sensitive evidence through a general marketing form. Use the official agency channels or a secure channel agreed with your representative.
Common questions
Is this Australia's subclass 866 process?
No. New Zealand's refugee and protection process is separate. Australian visa subclasses and ART procedures do not apply to a New Zealand claim.
Can I assume an appeal is available?
No. The decision type, circumstances and time limit must be checked. The tribunal's jurisdiction is not identical for every visa or immigration decision.
Where should I start?
Use Immigration New Zealand's official claim guidance and obtain qualified assistance. The Ministry of Justice provides information on the tribunal and legal aid.
